In our previous posts, we’ve discussed some of the pertinent laws that regulate window tint in across the nation. What we haven’t mentioned is the penalties for violations and how you can protect yourself against large sum traffic tickets and negative action toward your license privileges. What is Considered a Window Tint Traffic Violation?
Window tint violations occur in the color of tint and measurements of light transmittance and luminous reflectance. Violations are more common when a car enthusiast installs their own window tint or when the tint exists on the vehicle at the time of purchase. Further violations are common when a person with tinted car windows travels from a lenient state like Nevada into a state with strict tint laws like California.
If a law enforcement officer (LEO) suspects a tint violation, they will use a light transmission-measuring device called a photometer to determine if your vehicle’s tint film meets the light transmittance standards of your state’s window tint laws. In California, window tint violations are a primary traffic offense and can be the sole reason an LEO pulls you over.
What Are the Penalties For Window Tint Violations?
Penalties for window tint violations can range from a simple warning to hefty fines, depending on whether it’s your first offense and/or how much you are in violation. In most states, the escalation of penalties looks like:
- “Fix it” warning ticket that may range in no charge to a light fine of $25-50 that may be dismissed if you correct deficiencies.
- A second traffic stop for tint violations, or deficiencies that clearly violate laws (50% less VTL, for example, or a fully tinted windshield) may result in points being taken off your license and/or a fine of $100-250.
- A third infraction or gross disregard for the law may result in mandatory court hearings and fines upwards of $300.
How to Protect Yourself From Fines
1. Prevent Citation
Before you even find yourself being pulled over, you can protect yourself from tint-related traffic stops by getting your window film installed at a reputable tint shop that will certify your windows pass state inspections and will place a sticker proving such on your windows. LEO will see the certification indicator and likely won’t pull you over at all.
Another way you can prevent a traffic stop from occurring is by staying within the legal tint limit. Those who push the limit or exceed legal standards are at risk of being pulled over without committing other driving infractions. The best policy is not to draw attention to yourself, if at all possible.
If you have a medical condition that qualifies you for a medical exemption to the tint laws, you can apply for an exemption that will allow you to have a darker tint allowance than the average driver.

2. What to Say to LEO During Traffic Stop
If you do find yourself being stopped for a suspected tint infraction, there are a few things you can do to beat a ticket. Here are a few suggestions:
- Be respectful to the LEO and avoid giving them a reason to ticker you
- Err on the side of misunderstanding the law
- Most LEO will not cite you if you are temporarily in the state or just driving thru
- Let them know you’re on the way to Jet Black Tint to have the issues corrected
